TERMS AND CONDITIONS
All our Products made by us are subject to the following Terms and Conditions.
INGREDIENTS
It is possible that cakes, decorations, fondant, and other items may come into contact with nuts, soy, milk, wheat, and other items that cause allergic reactions.
It is the responsibility of the Customer to inform Iwantthatcake.co prior to the confirmation of their booking of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly the Supplier will not be held liable for any allergic reaction resulting from consumption of the cake.
You agree to advise your guests or anyone else who may come into contact with our products of this possibility and to indemnify us absolutely for any allergic reactions that may occur.
QUOTATIONS
All Quotations are valid for 7 days from the date of issue. A quote is not regarded as a booking.
ORDERS
We prefer at least fourteen (14) days’ notice for all orders, as we are continually booked in advance. We will however Endeavor, where availability permits accept short notice cakes. ‘Short notice’ means any order that is placed two weeks or less before the date the product is required.
Any Products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.
VARIATIONS IN DESIGN
- While Iwantthatcake.co makes every effort to provide exactly the flavour, filling, decoration, size, colour, shape, and design discussed during consultations, creating cake is an art form and may be subject to variations.
- If the customer supplies an image or likeness to be created, Iwantthatcake.co will make every attempt to make the item as close to the likeness as possible. In the event that the product requires equipment or ingredients that cannot be obtained within the time allotted (exotic flavours, moulds, shapes, stamps, texture, additional novelty such as glitter), the closest resemblance available will be used to complete the product.
- Colour matching is not a precise science and different sugar substrates take colour differently. Iwantthatcake.co will do everything possible to make substrates match to each other and to match provided colour swatches, but sometimes it is not possible to make a 100% perfect colour match and some colours are just not achievable using food grade dyes.
- Iwantthatcake.co cannot match a “verbal” colour, or a colour sent via electronic device, as all monitors display colour differently. To attempt a colour match, you must provide a colour swatch 14 days in advance of the event.
- To maintain stability and the integrity of your event cake, Iwantthatcake.co reserves the right to make design and structural changes to your cake on site or off, without prior notification.
CAKE FLOWERS
While we try our best to ensure that we get an exact match for florals, we have limited access to the flowers supplied at the flower markets. The accessibility of flowers is also based on the season. If you are wanting your cake florals to match the event flowers, advise your florist and ensure that they have sufficient flowers for us to add to your cake to match the design brief.
SUPPLYING YOUR OWN DECORATIONS/SUPPLIES
You are welcome to supply your own decorations such as figurines, ribbons, or flowers subject to the following conditions:
- You must ensure that any items that you supply meets hygiene and safety standards. Any item that is not considered by us to meet these standards will not be used by Iwantthatcake.co under any circumstances.
- If you supply any items for the cake, you are responsible for ensuring that there is a sufficient quantity of the correct type, size, and style for the design of your cake.
- If you supply a figurine for your cake, it must be able to be attached easily to the cake and should be capable of standing alone or being fixed with supports.
- Fresh flowers must be individually wired and taped with florist’s tape. If your flowers are not supplied in this way Iwantthatcake.co unconditionally reserve the right to refuse to place them on the cake.
- Posies or bunches of flowers must be wired and taped in a similar manner to individual flowers.
- Flowers can be delivered to either Iwantthatcake.co or the delivery address prior to the agreed delivery time. No responsibility will be accepted for any damage caused to the cake by any other person (including florists) placing flowers, or any other item, on the cake after it has been delivered and accepted by the venue.
- You must ensure that sufficient flowers are ordered and supplied by your florist. Any poor quality or damaged flowers supplied by you are your responsibility.
- Feel free to contact us or you may pass our details to your florist if you have any concerns or questions regarding these conditions.
DEPOSITS
A non-refundable deposit of 50% is required to hold your date.
Where we have delivered what is quoted and invoiced, but the Customer does not accept the finished Product, the deposit WILL NOT be refunded. The Customer can choose to pay the remainder and take the Product/s or leave them at no extra cost.
Where we cancel the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the Customer.
FINAL BALANCE PAYMENTS AND PICKUPS
The balance is due on or before pickup date, and before the Product leaves the premises.
Final amounts are settled by a bank transfer. We do not accept cash. When paying by internet transfer, the money needs to be in the account BEFORE the product leaves the premises.
It is the responsibility of the Customer to check the state of the product before leaving the premises. Once the item has left the premises, the Customer is responsible to ensure that products get to its destination safely and is stored as per our instructions to achieve best results for taste and quality.
If you, or someone representing you, choose to collect the cake, or set up the cake, you assume all responsibility and liability for the cake as soon as it leaves our possession. Cakes will generally be boxed however all risk and liability for transporting cakes is assumed by you.
DELIVERY
We offer delivery for certain destinations. Delivery is charged at our discretion
Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, we are not liable for any damages.
A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back with our premises, and it will be the customer’s responsibility to collect the product.
SETTING UP AT A VENUE
If it is determined by us that you are located at a reasonable distance for delivery, we will deliver the cake for a fee. Please contact us should you require a quote for delivery. Any delivery fee paid by you will include set-up at the venue subject to the following conditions:
- Acceptance of the cake at the venue indicates that it has been delivered /set up in good condition by us. Where delivery is required, anyone at the delivery address who receives the goods will be considered as being authorised by you to act on your behalf to receive the goods.
- We accept no responsibility for loss or damage to the goods after delivery/set up has occurred.
- As a general rule, we will photograph your cake at the venue as evidence that the cake has been delivered/set up in good condition. These photos may be reproduced or used by us for marketing/promotion purposes at our sole discretion with no compensation payable to you.
- The venue must be at a suitable temperature (an air-conditioned room is best) and a suitable table must be set up and available for the cake upon arrival. No responsibility can be accepted by us for any deterioration of the cake or decorations (fresh or otherwise) if these conditions are not met.
PUBLICATION
We reserve the right to use any image of a Product made by us for publication at a later date.
REFUNDS/CANCELLATION/POSTPONEMENT POLICY
POSTPONEMENT
If, for any reason the event is required to be postponed, please contact us immediately. The new date proposed will be subject to availability.
If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:
If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less your initial deposit and the cost of any supplies already purchased for your cake.
If the cancellation is less than seven (7) days prior to your event, there will be no refunds given.
Refunds will be paid within 14 days of cancellation.
Please note: Any non-refunded balance may be credited toward future purchases.
COVID POLICY
If you need to postpone your wedding/party/event due to covid-19 issues:
And we are available on your new wedding/party/event date:
then your deposit and any payments made towards the full/final balance will transfer and apply to the new party/event date*. The date for payment of any balance due will be recalculated to the day of delivery/pickup (or 4 weeks prior to new wedding date).
And we are not available on your new party/event date:
then 50% of your deposit will be refunded and any additional payments made towards the full/final balance will be refunded in full*.
*If work has already begun on your cake when you give notice:
then the cost of materials and time for decoration will be subtracted from the total deposit. 50% of the remaining deposit will be refunded. Iwantthatcake.co will provide a photo of work completed and itemised list of materials and costs will be provided. Examples are below, based on an $250, 24-serving cake with all standard flavours that has already been baked, filled, frosted and decoration work has started:
- Example A: we are available for your new date; however, you would owe an additional fee of $75 for the following: Materials ($25) + Decorating Time ($50 for 2 hours) = $75 additional fees
- Example B: we are not available** for your new date and you will be refunded as follows:
- You’ve paid the $125 deposit:
- Deposit ($125) - Materials & Decorating Time ($75) = Deposit Remaining ($50) = Deposit Refund ($25)
- You’ve paid the $125 deposit, plus you’ve paid $125 for the final/full balance:
- Deposit ($125) - Materials & Decorating Time ($75) = Deposit Remaining ($50) = Deposit Refund ($25) + Final Balance Refund ($125) = Total Refunded ($150)
*60-day notice must be provided. If new wedding date is inside of 60 days from the day you provide me with the new date and I'm not available, then the deposit is not refundable. Any balance paid will be entirely refunded.
